ARE YOUR LAND AND DEVELOPMENT PROSPECTS AT RISK?

The law on formulating planning policies has changed, and anyone with land and development interests should be aware of the changes, particularly the introduction of Local Development Frameworks. All local planning authorities have begun preparing a Local Development Framework (LDF) for their area, because planning applications must be determined against this new-style development plan from September 2007.

QUICKER PROCEDURE, EARLIER CONSULTATION, MORE DOCUMENTS

The reforms are intended to make planning more responsive to changing circumstances. Unlike the Development Plan, it is intended that LDFs are prepared more quickly, with greater flexibility and greater community involvement. One of the major changes is that the consultation process starts much earlier. West Waddy:ADP have up-to-date information on the stages that planning authorities have reached and are already involved with a number of them in their LDF process and consultation exercises.

Each LDF is made up of a number of different documents, which will be produced at different times. The timetable for producing these documents is set out by each planning authority in its Local Development Scheme and this will be updated annually. Therefore it is vital for anyone with land and development sites to be aware of what stage the relevant planning authority has reached.

West Waddy:ADP are in contact with ALL 70 local planning authorities responsible for producing LDFs in the South East, and a considerable number beyond. We are able to advise clients on any planning matters relevant to them in respect of their land and development interests. We recognise when and how to get involved in the consultations on relevant documents so that we can act positively for our clients, representing them and promoting land and its development potential which is likely to be affected by planning policies.

Because there are so many planning authorities in the South East, and they are all at a similar stage in the preparation of LDFs, there will be a considerable number of documents produced within a short period of time. The contacts we have already established with these authorities will ensure that we will remain up-to-date and informed of any changes to each Local Development Framework.

It is imperative that anyone with land and development interests should be aware of the new system and they should be seeking to be involved as early as possible in formulating planning policies.
